It’s really pretty simple:
1. We have a non-solicit, no-hire and non-compete with CardConnect. We have a non-compete with First
Data.
2. You can't hire a company out from under us that resells us while still reselling us.
3. We are going to use the full extent of our legal agreements, as First Data should as well, to enforce
#1-2 above.
4. You can't compete with companies you resell.
5. This is the perfect opportunity to test the non-compete in our agreements as it should present very well
in court.
6. Do not migrate any customers in #1-5 above that result in you breaking the non-compete.
7. First Data shouldn’t allow resellers to do this to other partners (us).
I am sure you don't want to be the one to test if legal agreements are enforceable or not. Do not
continue any customer migrations.
