Shift4 Payments Prevails Against CardConnect in Trade Secret Litigation

Allentown, PA – November 24, 2020 – Shift4 Payments (NYSE: FOUR), a leading provider of integrated
payment processing solutions, today announced that it has prevailed in its lawsuit against CardConnect,
LLC in the U.S. District Court for the Eastern District of Pennsylvania, Case No. 2:19-cv-01335-MAK.

The case stems from a legacy software agreement between Shift4 and CardConnect related to software
that Shift4 developed more than 15 years ago. After more than a year of litigation, including extensive
discovery and motion practice, the Court entered summary judgment in favor of Shift4 on the vast
majority of CardConnect’s claims, including its core allegation that Shift4 had purportedly disclosed
CardConnect trade secrets by making a software file (known as the PTC’) available for download
without credentials on an unprotected webpage. The Court held that, as a master of its complaint,
CardConnect was bound by the allegations in its complaint, and could not amend its complaint to
pursue a different and contradictory theory after the close of discovery. The Court also granted
summary judgment in favor of Shift4 on CardConnect’s CFAA, breach of contract (except with respect
to one contract provision), breach of the covenant of good faith and fair dealing, and tortious interference
claims.
